Funeral Video Cumbria
(A service provided by Liquid Studios)
1. Introduction
These Terms & Conditions govern the provision of videography and livestreaming services by Funeral Video Cumbria (“we”, “us”, “our”) to clients (“you”, “the Client”).
By booking our services, you agree to be bound by these Terms & Conditions.
2. Services Provided
We provide professional video recording and/or livestreaming of funeral and memorial services throughout Cumbria.
Services may include:
- Filming of funeral or memorial services
- Live streaming of services via secure online platforms
- Editing and production of a finished video
- Provision of digital downloads and/or physical media copies
- Archival storage (where agreed)
All services will be confirmed in writing prior to the event.
3. Booking & Payment
3.1 Booking Confirmation
A booking is confirmed once written confirmation is issued and, where applicable, a deposit has been received.
3.2 Fees
All fees will be confirmed in advance. Unless otherwise agreed:
A deposit may be required at the time of booking
The balance is due prior to delivery of the final video
We reserve the right to withhold delivery of footage until full payment has been received.
4. Cancellations
4.1 Client Cancellation
If you cancel:
- More than 48 hours before the service – deposit may be refundable at our discretion
- Within 48 hours – deposit is non-refundable
- On the day of the service – full fee may be payable
We understand funeral arrangements can change; we will always act reasonably and compassionately.
4.2 Our Cancellation
In the unlikely event we are unable to attend due to illness, emergency, or circumstances beyond our control, liability will be limited to a full refund of fees paid. We will make reasonable efforts to arrange a suitable replacement where possible.
5. Livestreaming Disclaimer
Livestreaming services rely on third-party platforms and internet connectivity at the venue.
While we take all reasonable steps to ensure a reliable broadcast:
- We cannot guarantee uninterrupted streaming
- We are not liable for failures caused by internet outages, venue restrictions, third-party platform issues, or force majeure events
- A recording may still be made locally where possible
6. Permissions & Venue Cooperation
It is the Client’s responsibility to:
- Obtain permission from the funeral director, celebrant, officiant, church, crematorium, or venue
- Ensure filming is permitted at the location
We will always operate discreetly and respectfully and comply with venue requirements.
7. Privacy & Data Protection
We understand the sensitive nature of our work.
We will:
- Handle all footage with discretion
- Use secure storage systems
- Not publish or share footage without written consent
- Footage is supplied solely for private family use unless otherwise agreed.
We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
8. Intellectual Property
Copyright in all recorded material remains with Funeral Video Cumbria unless otherwise agreed in writing.
Clients are granted a personal, non-commercial licence to:
- View
- Share privately with family and friends
Commercial use, public broadcasting, or alteration of footage requires prior written consent.
9. Limitation of Liability
We will provide services with reasonable care and skill.
Our liability for any claim arising from the provision of services shall be limited to the total fee paid.
We shall not be liable for:
- Indirect or consequential losses
- Emotional distress
- Technical failures beyond our reasonable control
- Loss caused by venue restrictions or third-party providers
Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.
10. Archiving & Retention
Unless otherwise agreed:
- Raw footage may be retained for a limited period (typically 30–90 days)
- Final edited videos may be archived for up to 12 months
After this period, we may delete files without further notice. Clients are responsible for maintaining their own backups.
11. Force Majeure
We shall not be liable for delay or failure to perform services due to events beyond our reasonable control, including but not limited to:
- Severe weather
- Road closures
- Illness
- Government restrictions
- Technical infrastructure failure
12. Complaints
If you are dissatisfied with any aspect of our service, please contact us in writing within 14 days of delivery. We will make reasonable efforts to resolve concerns promptly and professionally.
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
